Failed well water test in NJ: the lab report lands, one parameter sits over the limit, and a closing date that felt certain suddenly feels fragile. Here is the part nobody says up front. Under the New Jersey Private Well Testing Act, a failed result does not block the sale and does not require anyone to install treatment. NJDEP describes the PWTA as a consumer information law. It makes both sides read the numbers before title transfers. What comes next is an engineering question and a negotiation, not a legal wall. Below is every PWTA parameter group matched to the treatment NJDEP lists, guidance on who pays, and a realistic 6 to 8 week runway.
What a Failed Well Water Test in NJ Actually Means
The Private Well Testing Act was approved in March 2001, and NJDEP states the law went into effect on September 14, 2002. It requires sellers or buyers of property served by a potable private well to test the untreated groundwater for up to 43 parameters. NJDEP reports that approximately 25 percent of the wells in the state have been tested under the Act.
Three things follow from a failure.
- The sale can still close. NJDEP states the law does not prohibit the sale of property if the water fails one or more drinking water standards. In some cases and locations, mortgage companies or local health departments may require treatment of the water.
- Treatment is not mandatory. NJDEP states the law does not require water treatment be installed for water that fails to meet standards, and that installation is something to be discussed and negotiated between the buyer and the seller.
- Both parties must sign off. N.J.S.A. 58:12A-27 bars closing of title unless both the buyer and the seller have received and reviewed a copy of the water test results, and both must certify in writing at closing that they did.
The certified laboratory reports results to the person who requested the test, to NJDEP, and to the local health authority. NJDEP states that both the DEP and the local health authority are required to keep the address of tested wells confidential. If nearby well owners are later advised to test for a parameter of concern, the local health authority may not reveal the address of the impacted property.

Match the certification to the parameter. NSF describes NSF/ANSI 53 as covering filters certified to reduce a contaminant with a health effect, and the listings carry those claims one contaminant at a time, so a unit certified for reduction of lead is not automatically certified for reduction of arsenic. NSF/ANSI 42 covers aesthetic claims such as chlorine, taste and odor. NSF/ANSI 44 covers cation exchange water softener performance, with optional barium and radium 226/228 reduction claims, so a softener that also helps with iron is doing that on manufacturer performance data rather than on an NSF/ANSI 44 reduction claim. Ask to see the listing that names your parameter.
Bacteria on a Failed Well Water Test in NJ: Repair, Shock, Retest
Total coliform is scored presence or absence and the standard is zero. E. coli is run only when the coliform sample comes back positive. A coliform hit usually points to a pathway rather than a ruined aquifer: a loose or damaged well cap, a cracked casing, failed grout, animal activity, or recent well work that was never disinfected.
- Find and fix the entry point first. NJDEP describes the best approach as finding the bacterial source, eliminating it if possible, then disinfecting to remove the existing bacteria.
- Shock chlorinate. NJDEP recommends that this be performed by a private well professional, not the homeowner.
- Retest about two weeks later. NJDEP says the water should be tested about two weeks after the shocking process, which gives any remaining bacteria a chance to grow back to detectable levels if a source is still there. A same-week retest can read clean and fail again after closing.
- If it returns, install continuous disinfection. NJDEP lists ultraviolet light as a continuous disinfection option. Look for NSF/ANSI 55 Class A. NSF describes Class A systems as inactivating bacteria, viruses and cysts in contaminated water, while Class B systems reduce non-disease-causing bacteria in water that is already disinfected. That makes Class B the wrong answer for a PWTA bacteria failure.
UV works only on clear water. Sediment, iron, manganese and hardness shade the lamp and shorten sleeve life, so those get handled upstream. If shock chlorination leaves a taste or odor behind, a carbon filter certified to NSF/ANSI 42 for aesthetic effects handles that side of it.
Arsenic, Gross Alpha and Uranium After a Failed PWTA Test
New Jersey sets its arsenic standard at 5 ug/L, half the federal maximum contaminant level of 10 ug/L. NJDEP calls arsenic the second most common contaminant to fail primary drinking water standards in New Jersey private wells, and says over 80,000 private wells have been tested for it through the PWTA. The Piedmont Physiographic Province is the highest risk area, with roughly 17 percent of its private wells exceeding the New Jersey standard, against about 2 percent in Valley and Ridge, about 1 percent in the Highlands and under 1 percent in the Coastal Plain.
Arsenic occurs as arsenic III and arsenic V, and NJDEP notes the two can co-occur. This detail matters more than anything else on your quote. NJDEP lists anion exchange and reverse osmosis as arsenic V options only. If your water carries arsenic III and nobody speciated the sample, an anion exchange tank can be installed, paid for, and still fail the retest. Two-tank adsorption is the whole-house option NJDEP lists without that limit, and the first line on NJDEP's own homeowner checklist is that the system treats both arsenic 3 and arsenic 5. NJDEP also states that treating all the water in the home is the most effective way to reduce arsenic exposure, and recommends a whole house arsenic treatment system where arsenic is greater than 5 ug/L.
Gross alpha follows its own procedure. A result greater than 5 pCi/L requires a second gross alpha count, and the MCL is 15 pCi/L. Adjusted gross alpha subtracts uranium alpha activity, is calculated only when uranium is required or tested, and carries the same 15 pCi/L limit. A first-pass number over 5 is not yet a failure. It is the trigger for the confirmatory count. NJDEP recommends testing for radium 226 and 228 when a result lands between 5 and 15 pCi/L, and further testing for uranium, radium 226 and 228 and radon above 15 pCi/L.
The fix depends on the source. Where radium drives the result, NJDEP lists whole-house cation exchange, and softeners in the NSF listings can carry a radium 226/228 reduction claim. Where uranium drives it, NJDEP lists whole-house anion exchange, with reverse osmosis at a single tap. Uranium is a required PWTA parameter in 12 counties, Union, Essex and Morris among them, at 30 ug/L. One honest caveat: the NSF certified product listings under standards 53 and 58 do not carry a uranium reduction claim, so ask the manufacturer for performance data specific to uranium and prove the result with a post-install sample analyzed by an NJDEP-certified laboratory.
Nitrate, PFAS, VOCs and the Aesthetic Failures on a NJ Well Water Test
Nitrate fails at 10,000 ug/L, which is 10 mg/L. NJDEP lists whole-house anion exchange and single tap reverse osmosis, and reverse osmosis units in the NSF listings carry a nitrate and nitrite reduction claim under NSF/ANSI 58. Because nitrate often traces to septic systems or fertilizer, read nitrate and coliform together. Both elevated at once points to a surface pathway worth investigating first.
New Jersey has maximum contaminant levels for three PFAS compounds and the PWTA tests all three: PFOA at 0.014 ug/L, which is 14 parts per trillion, PFOS at 0.013 ug/L and PFNA at 0.013 ug/L. NJDEP lists granular activated carbon filtration. Look for units certified to NSF/ANSI 53 for reduction of PFOA and PFOS, or for total PFAS.
Volatile and synthetic organic limits run tight. Benzene, trichloroethylene and tetrachloroethylene sit at 1 ug/L, vinyl chloride at 2, MTBE at 70, ethylene dibromide at 0.05. NJDEP lists granular activated carbon filtration and air stripping. Whole-house carbon is the usual choice because VOCs also leave the water during showers and laundry. Where a VOC result traces to a human-caused discharge of a hazardous substance, the NJ Spill Compensation Fund damage claims program may apply to innocent parties who meet its eligibility requirements.
Iron at 0.3 mg/L, manganese at 0.05 mg/L and pH outside 6.5 to 8.5 are recommended upper limits for secondary parameters rather than health-based standards. Do not skip them. NJDEP lists a water softener or oxidation and filtration for iron and manganese, and an acid neutralizer for pH. These foul UV lamps, blind RO membranes and shorten arsenic media life, so on a multi-parameter failure they go first in the treatment train. Correcting low pH also reduces the water corrosiveness that mobilizes lead, which is the first item on the NJDEP lead treatment list.
Who Pays After a Failed Well Water Test in NJ
NJDEP is direct here. The law does not require water treatment be installed, so installation is something to be discussed and negotiated between the buyer and the seller. The same holds for the sampling. On a sale, PWTA testing costs are negotiated between the buyer and the seller. On a lease, the landlord must obtain and pay for the testing, provide the results to the tenant, and get a full PWTA test done every five years.
One number is published. NJDEP estimates that the average price of a full PWTA test is between $1,200 and $1,500, with additional cost where the field blank collected alongside the sample has to be analyzed, which is required for PFAS and VOCs. Treatment pricing is another matter, and anyone quoting a range before seeing your numbers is guessing. Installed cost swings on the parameter, the flow rate the house needs, point of entry versus point of use, tank count, plumbing access, and whether the well itself needs work. Get it in writing, parameter by parameter, with the retest included.
Four deal structures come up most often.
- Seller installs before closing and supplies a clean post-treatment lab result. Cleanest for the buyer, slowest on the calendar.
- Seller credit at closing. Fast, though the buyer inherits scope risk and contractor selection.
- Escrow holdback. Workable, and it fails when the language is vague. Name the acceptance standard, the lab, who selects the contractor, the deadline and who pays for the retest.
- Price reduction, with the buyer handling the work after closing.
Two state funding programs exist. The NJHMFA Potable Water Program is a no-interest second mortgage loan of up to $10,000 for owners of single family residences whose private well water violates New Jersey primary drinking water standards or the standards for sodium, chloride, lead, mercury, iron or manganese, and the proceeds can pay for treatment technology or an alternative potable water supply. The NJ Spill Compensation Fund damage claims program offers help to innocent parties suffering damages from a human-caused discharge of a hazardous substance.

Closing Timeline After a Failed Well Water Test: a 6 to 8 Week Runway
Start with the trap that costs deals. Under the PWTA rules the sample must be collected as an untreated water sample, so if the plumbing has any kind of treatment the sample is collected before the water goes through it. Installing a system therefore does not change your PWTA number. The PWTA result still shows the failure, and that is normal. The document proving your fix worked is a separate post-treatment sample taken after the equipment.
Validity buys room. Where a sample was collected and tested in accordance with all the requirements of the PWTA rules at N.J.A.C. 7:9E, the results may be used to comply with the law for one year after the sample was collected. Total coliform results are valid for six months, so past that point only another total coliform sample needs to be collected rather than the full panel.
The schedule below is our own planning estimate, not a rule, and lab turnaround is the variable.
- Week 1. Results in. Confirm the failure and separate primary health standards from secondary aesthetic ones.
- Week 2. Quotes in writing. Settle scope, credit or holdback language during attorney review rather than after it.
- Weeks 3 to 4. Order equipment and schedule the licensed New Jersey master plumber. Media tanks and Class A UV units are not always on the shelf.
- Week 5. Install. Bacteria jobs begin with the source repair and shock chlorination.
- Weeks 6 to 7. Post-treatment sampling. Bacteria retests wait about two weeks after shocking per NJDEP guidance, which sets the floor on this timeline.
- Weeks 7 to 8. Results, sign-off and closing.
Sampling has rules of its own. The sample must be collected by an individual certified to collect PWTA samples or by an authorized representative of a laboratory, and samples for pH testing must be collected by an employee of a laboratory certified to test for pH. More than one certified lab may be used, but the PWTA rules require that one lab coordinates and submits all the PWTA results to NJDEP electronically.
Notes for Realtors, Attorneys and Lenders on a Failed Well Test
Contract language does most of the work. Every contract of sale for a covered property must include a provision requiring the testing as a condition of the sale, and at closing both parties certify in writing that they received and reviewed the results. Where a failure is in play, specify the parameter, the acceptance standard, the certified lab, the deadline and who pays for the retest. Check the local overlay too. NJDEP states that where a local jurisdiction also requires private well testing, both the local and state requirements must be met, and the more stringent of the two is followed.
FHA files add real requirements. Under HUD Handbook 4000.1, when an Individual Water Supply System is present the mortgagee must ensure the water quality meets the requirements of the health authority with jurisdiction, and where there are no local or state water quality standards, quality must meet the EPA National Primary Drinking Water Regulations at 40 CFR 141 and 142. A well water test is required for, but not limited to, properties that are newly constructed, where an appraiser has reported deficiencies with the well or the well water, where water is reported or known to be unsafe, that are located in close proximity to dumps, landfills, industrial sites, farms or other sites that could contain hazardous wastes, or where the distance between the well and septic system is less than 100 feet. All testing must be performed by a disinterested third party, including collection and transport of the sample, and at no time may the borrower, owner or other interested party collect or transport it. For existing construction the handbook lists minimum distances of 10 feet to the property line, 50 feet to a septic tank and 100 feet to a drain field, with the drain field distance reducible to 75 feet if allowed by the local authority, and local requirements prevail where they are greater.
One FHA detail changes equipment selection. The handbook directs the appraiser to note the deficiency of minimum property requirements or standards where the property has a water source that includes a mechanical chlorinator. On an FHA file that is a practical argument for solving a bacteria failure with a Class A UV system rather than a chlorine injection setup.
For VA-guaranteed loans, 38 CFR 36.4351 sets minimum property and construction requirements by reference to the standards the Secretary prescribes, and the water documentation a given lender wants can vary.
